PRIVACY NOTICE

Privacy Notice addressed to the Data Subjects whose Personal Data are in the possession of "RED POR LA IGUALDAD, JUSTICIA SOCIAL, DERECHOS HUMANOS, SALUD REPRODUCTIVA Y SEXUAL. ASOCIACION CIVIL" (hereinafter referred to as the "Association"), as a result of the fulfillment of its social purpose, through its projects, programs, websites, and/or platforms, in which there is interaction with said Association.

RESPONSIBLE PARTY

"RED POR LA IGUALDAD, JUSTICIA SOCIAL, DERECHOS HUMANOS, SALUD REPRODUCTIVA Y SEXUAL. ASOCIACION CIVIL," (hereinafter the "Association"), with its address located at Londres Street, number 151, second floor, Juárez neighborhood, postal code 06600, Cuauhtémoc Borough, Mexico City; is responsible for collecting your personal data, using it, and protecting it.

PERSONAL DATA

The Association informs you that, as part of the fulfillment of its social purpose through various projects, programs, websites, and/or platforms, it may collect the following categories of personal data from you:

Identification and information of Donors.

Contact information.

Property-related information.

Health-related information.

Employment-related information.

PURPOSE OF PROCESSING PERSONAL DATA

Your personal information will be used, in compliance with the social purpose, which includes receiving donations, providing orientation, support, and accompaniment services to people living with HIV, as well as complying with various applicable regulations to the Association.

For the aforementioned purposes, we may need to obtain one or more of the following personal data: name, surnames, phone number (mobile and landline), photograph, email, address, proof of address, gender, age, economic data, Tax ID (RFC), Unique Population Registry Code (CURP), copy of official identification, INE (National Electoral Institute), nationality, passport number, marital status, military service card number, driver's license class and number, hobbies, favorite sport, language proficiency, proof of studies, work experience, knowledge and skills, responsibilities, attendance, punctuality, employment preferences, job position, company name, address, period of employment, reason for termination of employment relationship, and mobile and landline phone number of the current or past employer, letters of recommendation (employment and personal), IMSS clinic number, salary, non-compliance records, sanctions, absences, overtime, benefits, deductions, immediate supervisor, current occupation, monthly income, payroll number, and the following financial or property-related data: account numbers, transfer amount, card number, bank accounts, withdrawal bank code, CLABE and retirement account.

SENSITIVE PERSONAL DATA

The Association informs you that, as part of its various projects, programs, and/or platforms, it may collect sensitive personal data from you, which fall into the corresponding category:

Current and future health status.

Sexual orientation.

Identity and/or gender expression.

The personal data and sensitive personal data (hereinafter "Personal Data") that may be collected, may be processed by the Association for the following purposes:

Primary

Due to the legal relationship that exists with you, as a donor, beneficiary, or employee.

For Administrative purposes.

For Operational purposes.

Secondary

To send you the monthly newsletter and/or invitations to Association events.

So that your employment profile can be entered into the job market of companies affiliated and/or related to the projects, programs, and/or platforms of the Association.

For Statistical and/or Prospecting purposes.

If you wish to express your refusal to the processing of Personal Data for secondary purposes, you must submit a signed letter with: (i) full name of the Data Subject and (ii) the address or other means to communicate the response to your request, at the following address: Londres Street, number 151, second floor, Juárez neighborhood, postal code 06600, Cuauhtémoc Borough, Mexico City; briefly indicating in the letter what your request refers to (the "Secondary Purposes Request"). To verify your identity, you must accompany the Secondary Purposes Request with a copy and the original for verification of your valid official identification. If the request is made through a legal representative, the identity and personality of the latter must be accredited.

INFORMATION TO BE COLLECTED

For the purposes indicated in this privacy notice, we may collect your personal data in various ways:

When you provide them directly through any medium (identification data such as donors, beneficiaries, derived from the employment relationship with the Association, contact, statistical, and socio-economic studies).

When you visit our website (use of cookies and web beacons, electronic registration).

When we obtain information through other sources allowed by the Law (telephone directories, market research agencies, advertising agencies).

When you provide them through job applications, whether physical or electronic, in connection with the employment relationship(s).

The Association will treat your personal data only for the time allowed by the Law, which is why the Association will delete your information after this period has elapsed.

DATA TRANSFERS

The Association may transfer your health, identification, contact, property-related, and employment-related personal data without your consent, when any of the assumptions provided in article 37 of the Federal Law on Protection of Personal Data held by Private Parties (hereinafter the "Law") are met. Conversely, if the assumptions of article 37 of the Law are not applicable, the Institution may transfer your Identification, Contact, Financial, Property-related, Academic, Health, and/or Employment-related personal data only when it previously obtains your consent. This transfer may be made to: (i) Private Assistance Institutions, (ii) Civil Associations, (iii) Decentralized and/or Deconcentrated Public Bodies, (iv) Public and/or Private Hospitals, (v) Job market of companies associated with the projects, programs, and/or platforms offered by the Association, and (vi) Public or private entities related to the provision of health care, medical treatment, or the management of health services and Social Assistance Institutions, for the following purposes:

Prevention or medical diagnosis, the provision of health care, medical treatment, or the management of health services.

Regulatory Compliance before government authorities.

For Statistical purposes.

Employment.

If you wish to express your refusal to any of the purposes described above, you must submit a signed letter with: (i) full name of the Data Subject and (ii) the address or other means to communicate the response to your request, at the following address Londres Street, number 151, second floor, Juárez neighborhood, postal code 06600, Cuauhtémoc Borough, Mexico City; briefly indicating in the letter what your request refers to (the "Transfer Request") and to verify your identity, you must accompany the Transfer Request with a copy and the original for verification of your valid official identification. If the request is made through a legal representative, the identity and personality of the latter must be accredited.

ARCO RIGHTS

The holders of personal rights held by the Association may exercise the right to ACCESS their personal data and details of their processing, as well as to RECTIFY them if they are inaccurate or instruct their CANCELLATION when they consider them to be excessive or unnecessary for the purposes that justified their obtaining, or OPPOSE their processing. These rights are referred to as ARCO Rights.

DATA TRANSFERS

The free-form letter must contain at least the following information:

  • Name of the data subject, address, phone, and email (if applicable).

  • Copy of the data subject's official identification (INE, current Passport, and/or military card).

  • Description of the purpose of the letter, which may include, but is not limited to: (i) Revocation of consent to process personal data; and/or (ii) Notification of the improper use of personal data processing; and/or (iii) Exercise of ARCO Rights, with a clear and precise description of the data to Access, Rectify, Cancel, or Object. In the case of Rectification of personal data, it must indicate the exact modification and attach supporting documentation; and

  • Any other element or document that facilitates the location of personal data, for example, to whom and/or which department they were provided.

The Association informs you that when revoking your consent, not in all cases can the request be immediately addressed or concluded, as it is possible that legal obligations may require continued processing of your personal data. Additionally, for certain purposes, revoking consent may imply that the Association cannot continue a legal relationship that exists with you.

How can you limit the use or disclosure of your personal information? By registering in the "Exclusion" list of the Association, so that your Personal Data are not processed: (i) To send newsletters, (ii) To send invitations to events, (iii) For your employment profile to be entered into the job market of companies affiliated and/or related to the projects, programs, and/or platforms of the Institution and/or (iv) For statistical and/or prospecting purposes. The Association reserves the right to update and/or modify this Privacy Notice at any time, in which case it will be made known through its publication at the following web address: www.circulodiverso.org.

This privacy notice, as well as the overall handling of the Law by the Institution, is governed by the current and applicable legislation in the United Mexican States. Therefore, any dispute arising from its application must be brought before the competent Jurisdictional Bodies in Mexico City.
